1. Purpose and Scope

1.1 This Acceptable Use Policy (“Policy”) sets out the rules that apply to all users of the AERIS platform and any services provided by AERIS, including the AERIS Marketplace (“Platform”).

1.2 This Policy forms part of the AERIS Terms of Service. By accessing or using the Platform, you agree to comply with this Policy. Capitalised terms used but not defined in this Policy have the meanings given to them in the Terms of Service.

1.3 This Policy applies to all users, including account holders, authorised users within a customer business, and any person accessing the Platform on behalf of a customer business.

2. Prohibited Conduct

You must not, when using the Platform or any AERIS-provided service:

2.1 Illegal Activity

  • (a) Engage in any activity that is unlawful under applicable Australian or international law.
  • (b) Use the Platform to support, plan, facilitate, or commit any illegal activity, including fraud, money laundering, or the financing of criminal enterprises.

2.2 Spam and Unsolicited Communications

  • (a) Use AERIS Marketplace email or SMS services to send commercial electronic messages to recipients who have not provided their consent, or whose consent has been withdrawn, in breach of the Spam Act 2003 (Cth).
  • (b) Send messages that do not include clear and accurate sender identification, accurate contact information for the sending business, or a functional unsubscribe mechanism that allows recipients to opt out of future messages.
  • (c) Ignore or fail to act on unsubscribe requests within the timeframe required by the Spam Act 2003 (Cth) (five business days from receipt of the request).

2.3 Harmful or Infringing Content

  • (a) Use the Platform to create, store, transmit, or distribute content that is defamatory, fraudulent, obscene, threatening, or harassing.
  • (b) Use the Platform in a manner that infringes the intellectual property rights, privacy rights, or other legal rights of any third party.

2.4 Unauthorised Access and Security

  • (a) Attempt to gain unauthorised access to the Platform, AERIS’s systems or infrastructure, or any other customer’s data or account.
  • (b) Probe, scan, or test the vulnerability of the Platform or any connected system without AERIS’s prior written authorisation.
  • (c) Introduce malware, viruses, trojans, ransomware, or any other malicious code into the Platform or any connected system.
  • (d) Intercept, monitor, or interfere with communications or data transmitted through the Platform by other users.

2.5 Reverse Engineering and Circumvention

  • (a) Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying algorithms of the Platform or any of its components, except to the extent expressly permitted by applicable law (including section 47D of the Copyright Act 1968 (Cth)).
  • (b) Circumvent, disable, or interfere with any security, access control, or technical protection measure implemented in the Platform.

2.6 Automated and Excessive Use

  • (a) Use bots, scrapers, crawlers, automated scripts, or other automated systems to interact with the Platform in a manner that exceeds normal human use patterns or places undue load on AERIS’s infrastructure.
  • (b) Conduct load testing, stress testing, or performance benchmarking of the Platform without AERIS’s prior written consent.

2.7 Competitive Use

  • (a) Use the Platform, or any data or insights derived from it, to develop, build, or assist in the development of a product or service that competes with AERIS.
  • (b) Access the Platform for the purpose of monitoring its features, functionality, or performance for competitive intelligence purposes.

2.8 Unauthorised Resale and Distribution

  • (a) Resell, sublicense, white-label, or commercially redistribute access to the Platform or any AERIS service to third parties without a prior written agreement with AERIS.
  • (b) Misuse AERIS Marketplace consumable credit by reselling it, transferring it outside the customer business’s account, or attempting to circumvent the prepaid credit model in any way.

3. AERIS Marketplace: Service-Specific Rules

3.1 Email and SMS Consumables

When using AERIS Marketplace email or SMS services, you must:

  • (a) Hold valid, documented consent from each message recipient in accordance with the Spam Act 2003 (Cth) before sending any commercial electronic message.
  • (b) Maintain accurate records of consent obtained from recipients and of all unsubscribe requests received.
  • (c) Act on unsubscribe requests within five business days of receipt and ensure that unsubscribed recipients are not sent further commercial messages.
  • (d) Use only approved sender IDs and not impersonate any other business, brand, or individual in the sender identification field of any message.
  • (e) Ensure that all messages include accurate contact information for your business and a clear, functional unsubscribe mechanism.

3.2 You acknowledge that AERIS monitors Marketplace usage for patterns consistent with spam, abuse, or violation of this Policy. AERIS may suspend access to Marketplace services immediately and without prior notice where usage patterns suggest a breach, pending investigation. AERIS will notify you of any such suspension as soon as practicable.

4. Enforcement

4.1 AERIS investigates all suspected violations of this Policy. Upon completing an investigation, AERIS may, at its discretion, take one or more of the following actions:

  • (a) issue a written warning to the account holder;
  • (b) suspend access to specific Platform features or Marketplace services;
  • (c) suspend the entire account pending further investigation or remediation;
  • (d) terminate the account in accordance with the Terms of Service;
  • (e) report the conduct to relevant law enforcement or regulatory authorities; or
  • (f) pursue civil legal remedies available under applicable law.

4.2 Where AERIS suspends or terminates an account due to a breach of this Policy:

  • (a) the customer remains liable for all fees and charges accrued up to the date of suspension or termination; and
  • (b) any unused prepaid Marketplace credit is forfeited and will not be refunded, except where required by law.

4.3 AERIS’s decision to take enforcement action under this clause does not limit any other rights or remedies available to AERIS under the Terms of Service or applicable law.

5. Reporting Violations

5.1 If you become aware of any conduct that may breach this Policy, including misuse of the Platform by another user, you are encouraged to report it to AERIS at:

5.2 AERIS will acknowledge abuse reports within two business days and will investigate all reports in good faith. AERIS will not disclose the identity of a person who makes a report in good faith, except where required by law.

6. Changes to This Policy

6.1 AERIS may update this Policy from time to time to reflect changes in the Platform, applicable law, or industry best practice. Material changes will be notified in accordance with the Terms of Service before they take effect.

6.2 Continued use of the Platform after the effective date of any updated Policy constitutes acceptance of the updated terms.
